1. Acceptance of Terms

By downloading, installing, or using TrailMapper ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and ProDirt LLC, a Virginia-based company ("we," "us," or "our").

2. Description of Service

TrailMapper is a GPS trail recording and mapping application for recreational trail builders, property owners, and outdoor professionals. The App allows users to:

• Record GPS trail segments using the device's location services
• Build and manage connected trail networks on properties
• Place and manage points of interest on trail maps
• Export trail data as KML or GPX files for use in third-party mapping tools
• Generate excavator work quotes tied to trail segments
• Back up and restore trail data via the Android Storage Access Framework

3. Use of the App

You agree to use TrailMapper only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable federal, state, or local laws
• Use the App to record GPS data on property you do not own or do not have explicit permission to access
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to any systems connected to the App

You are solely responsible for ensuring you have the right to access and record data on any property where you use the App.

4. Location Data and Privacy

TrailMapper requests access to your device's GPS location to record trail segments. Location access is used only while a recording session is active. The app displays a persistent foreground notification whenever location recording is in progress.

All GPS data and trail information is stored locally on your device. ProDirt LLC does not collect, transmit, or store your location data or trail information on its servers.

Optional features that involve third-party services:

• Map Tiles (OSMDroid / OpenStreetMap): Background map tiles are loaded from OpenStreetMap servers. No personal data or GPS coordinates are transmitted in these requests.
• Backup via Storage Access Framework: You may choose to back up your data to any location supported by Android's SAF, including Google Drive. ProDirt LLC has no access to your backup files.

5. Intellectual Property

TrailMapper and all related content, features, and functionality are owned by ProDirt LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal or business purposes.

You retain full ownership of all data you create within the App, including trail records, GPS coordinates, and quoting information.

6. Disclaimer of Warranties

TrailMapper is provided "as is" and "as available" without warranties of any kind, either express or implied. ProDirt LLC does not warrant that:

• GPS recording will be continuous, accurate, or uninterrupted under all conditions
• Exported KML or GPX files will be compatible with all third-party applications
• Pricing calculations in the quoting system will be accurate or suitable for your specific project
• The App will be free of errors or operate without interruption on all devices

GPS accuracy depends on device hardware, environmental conditions, and signal availability. You are responsible for verifying all exported data before relying on it for construction, legal, or property-related purposes.

7. Limitation of Liability

To the fullest extent permitted by law, ProDirt LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TrailMapper, including but not limited to:

• Inaccurate GPS recordings used for trail construction or property planning
• Loss of trail data due to device failure, software bugs, or accidental deletion
• Business decisions made based on quoting calculations from the App
• Injuries or property damage arising from trail construction informed by App data

Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid for the App.

8. Third-Party Services

TrailMapper uses the following third-party services. Your use of these services is subject to their respective terms and policies:

• OpenStreetMap: Map tile data subject to OpenStreetMap's terms
• OSMDroid: Open source library for map rendering, licensed under Apache 2.0
• Google Drive (optional): If used for backup, subject to Google's Terms of Service

ProDirt LLC is not responsible for the availability, accuracy, or practices of any third-party services.

9. Updates to the App

We may update TrailMapper from time to time to add features, fix bugs, or improve performance. Updates are distributed through the Google Play Store. We reserve the right to modify or discontinue the App at any time.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the App after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
